JVZoo AFFILIATE AGREEMENT

This agreement includes clauses that are included in many Affiliate Agreements such as Term, Modification, Limitation of Liability, Independent Investigation, Anti-SPAM and Miscellaneous terms that relate all governing laws to a state or local legislature.

This agreement describes the terms and conditions for participation in the JVZoo.com Affiliate Program. The terms "Affiliate," "you," and "your" are referring to you, the applicant. "We" and "our" refer to JVZoo.com.

We are independent parties and this agreement will not form any partnership.

AGREEMENT DURATION

This agreement will begin upon our acceptance of your affiliate application and will end when terminated by either party.

Termination may happen at any time, with or without cause, by giving the other party written notice of termination.

MODIFICATION

By posting a Change Notice or a new agreement on this site, we may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUE PARTICIPATION IN THE PROGRAM following the posting of a Change Notice or new agreement, it will be considered as your acceptance of the change.

COMMISSION FEES

You will receive 95% of the revenue per sale as a commission from orders placed through your Affiliate Site.

CUSTOMERS

Customer refers to anyone that has bought a product through the JVZoo.com network/system, not to customers of the network itself who are defined as Vendors or Affiliate (see below).

As a customer you should consult with the vendor of any product to establish what your refund/guarantee rights are. We encourage all vendors to clearly list this on their sales page but it doesn’t always happen.

To claim your refund you should contact the support department of the company who sold you the product.

VENDORS

You are a Vendor if you sell any product through the JVZoo.com network/system.

In order to process refunds for Adaptive Payments you are required to provide JVZoo.com with “Refund” permissions on your PayPal account. This is taken care of automatically when you link a PayPal account with your JVZoo.com account. Removal of this permission will result in immediate suspension of your JVZoo.com account.

JVZoo also required permission to pull transaction details on transactions that we initiate into your PayPal account. Removal of this permission will result in immediate suspension of your JVZoo.com account.

You are free to set and enforce any refund policy on your own products but must honor any legal obligations applicable to your own sales.

JVZoo.com treats fraud very seriously and prevents serial offenders from purchasing your products. If you suspect that someone has issued a fraudulent refund claim please bring it to our attention by emailing support@JVZoo.com

For a sale to generate a commission to an Affiliate, the customer must complete the order form, remit full payment for the service ordered and have their installation completed. You will receive percentage you specified during product setup (minus JVZoo fees) for orders placed through the Affiliate Sites of those sub-Affiliates which you have approved into the JVZoo Affiliate Program. Affiliate commissions will only be paid on sales which are made through qualified Affiliates.

Affiliates must have an active link on their website. In order to qualify for commissions on sub-affiliate sales in any given month, an affiliate must personally sell at least one order during that month.

The JVZoo Marketplace is specifically for vendors using the JVZoo platform to process payments and delivery for their products. Vendors will not be allowed to list any product in the JVZoo Marketplace unless using the JVZoo Platform as the payment processor. If found attempting to add products being sold through different processors, your listing will be removed immediately and your account could be terminated. This does not mean you cannot have a product on places such as Clickbank, Share-A-Sale or similar. It simply means you cannot put up the page you sell from those platforms with the alternate payment processors button on the page which you have listed in the JVZoo Marketplace.

JVZoo.com is able to promote ANY product listed in the JVZoo.com system as an affiliate. This applies to ALL products even, products not listed in the the Consumer or Affiliate marketplace.

The JVZoo system of is designed specifically with the safety of the sellers in mind this includes but is not limited to the affiliate request and approval process, the adding of products and blacklist system. The use of bots to automate or circumvent any part of the JVZoo system is strictly prohibited by JVZoo.com. Anyone caught using such bots or attempting to circumvent the system will be banned from using the site.

VENDOR FEES

Vendors agree to allow PayPal to send JVZoo.com 5% of the selling price on all items listed, unless the Vendor has chosen to pay a one time fee for a particular item. Only Vendors using the JVZoo.com platform to sell products and services on the WarriorForum.com's "Warrior Special Offer" section have the option of paying a one time fee of $17.00 per item before the first sale is made. Vendors that choose this option will not incur the 5% fee per sale for that particular item. A one penny ($0.01 USD) fee per transaction will be applied to Vendors for each sale of a flat fee only item if that sale was NOT referred by a registered JVZoo.com Affiliate.

WEBSITE RESTRICTIONS

JVZoo.com reserves the right not to accept any site into the JVZoo.com based on site content. Sites that Do Not Qualify for the JVZoo.com Affiliate Program include sites such as sites that are:

X-rated and promote sexually explicit materials
Promoting violence and discord.
Promoting discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
Promoting illegal or questionable activities
Violating intellectual property rights

SPAM (UCE)

Unsolicited Commercial E-mail - JVZoo.com in no way participates in mass unsolicited e-mailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the JVZoo.com Affiliate Program, with no refund.

DISCLAIMER

We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the JVZoo.com Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or down time.

This Agreement will be governed by the laws of the United States and the District of Columbia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the Federal or State courts located in Ocean Springs, Mississippi, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By signing up for an account on JVZoo.com, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.

*Please note that NO COMMISSION is paid on your original purchase from JVZoo.com. In other words you cannot buy from yourself or be your first purchase for the sole purpose of discounting your own product purchase.
